These Terms govern your access to and use of the Edufocus website, mobile applications, software platform, marketplace, AI Tutor and related educational services.

1. Acceptance of Terms

Welcome to Edufocus. These Terms and Conditions ("Terms") govern your access to and use of the Edufocus website, mobile applications, software platform, marketplace, AI Tutor and related educational services.

Edufocus is operated by EDRACLE TECHNOLOGIES PRIVATE LIMITED ("Edufocus", "Company", "we", "us" or "our").

By registering for an account, accessing the platform, purchasing a service, enrolling in a course or otherwise using Edufocus, you agree to these Terms.

If you do not agree with these Terms, you should not use Edufocus.

2. About Edufocus

Edufocus is a technology-enabled education platform connecting students, parents/guardians, tutors, teachers and educational institutes. Depending on availability, Edufocus may provide:

  • Tutor and academy discovery.
  • Course and batch discovery.
  • Online, offline and hybrid learning workflows.
  • Student dashboards.
  • Guardian access.
  • Tutor profiles and management tools.
  • Institute management features.
  • Attendance and homework management.
  • Learning materials.
  • Fee and payment tracking.
  • AI-powered learning assistance.
  • Communication tools.
  • Referral and reward programmes.

3. User Eligibility

Users must provide accurate information when creating an account.

Students who are minors may use relevant services with appropriate parent, guardian, institutional or other legally authorised involvement, where required.

By using Edufocus, you confirm that:

  • Information supplied by you is accurate.
  • You will keep account information updated.
  • You will not impersonate another person.
  • You will not create an account using false information.
  • You will use the platform lawfully.

4. Account Registration and Security

Users are responsible for maintaining the confidentiality of their login credentials.

You must immediately notify Edufocus if you believe:

  • Your account has been compromised.
  • Someone has accessed your account without permission.
  • Your login credentials have been disclosed.
  • You are responsible for activities performed through your account unless caused by circumstances for which you are not legally responsible.

5. Student Responsibilities

Students must:

  • Use the platform for legitimate educational purposes.
  • Respect tutors, teachers, institutes and other users.
  • Submit original work where required.
  • Avoid cheating, harassment or abusive conduct.
  • Respect intellectual property.
  • Not misuse communication features.
  • Not share another user's private information.

6. Guardian Responsibilities

Guardians are responsible for:

  • Providing accurate information.
  • Maintaining account security.
  • Ensuring appropriate use of linked student accounts.
  • Reviewing relevant learning, attendance and payment information.
  • Providing appropriate supervision of minor users.
  • Edufocus may request verification of the guardian-student relationship.

7. Tutor and Teacher Responsibilities

Tutors and teachers are responsible for:

  • Providing accurate profile and qualification information.
  • Maintaining professional conduct.
  • Providing accurate educational content.
  • Respecting student privacy.
  • Maintaining appropriate communication with students.
  • Complying with applicable laws and institutional requirements.
  • Edufocus may verify, review, suspend or remove tutor profiles where information is inaccurate, incomplete, misleading or otherwise inconsistent with platform standards.

8. Institute and Academy Responsibilities

Institutes and academies are responsible for:

  • Providing accurate institutional information.
  • Maintaining authorised access.
  • Managing their staff and user permissions.
  • Maintaining confidentiality of student information.
  • Providing accurate course, batch, fee and schedule information.
  • Complying with applicable education, consumer, tax, privacy and other laws.
  • Where an institute controls student records and instructs Edufocus to process them, the parties' respective data-processing responsibilities may be governed by additional contractual arrangements.

9. Marketplace and Third-Party Education Providers

Edufocus may display profiles, courses, classes or services offered by independent tutors, teachers, academies or institutes.

Information supplied by such providers is their responsibility. Edufocus may take reasonable steps to verify profiles, but verification does not constitute a guarantee of:

  • Educational quality.
  • Academic results.
  • Employment outcomes.
  • Tutor performance.
  • Course suitability.
  • Accuracy of every provider statement.
  • Users should independently evaluate a tutor, teacher, academy or institute before making a learning decision.

10. Courses, Classes and Enrolments

Course, batch and class availability is determined by the relevant tutor, academy or institute.

Before payment, users should review:

  • Course details.
  • Duration.
  • Schedule.
  • Mode of learning.
  • Fees.
  • Installment terms.
  • Refund terms.
  • Applicable eligibility requirements.
  • Once an enrolment is confirmed, the applicable provider's course or batch terms may also apply.

11. Fees and Payments

Fees displayed on Edufocus may include applicable taxes or charges as indicated at checkout.

Payments may be processed through third-party payment gateways. Edufocus does not guarantee uninterrupted availability of any third-party payment service.

Users must not initiate fraudulent transactions, chargebacks or payment disputes without a legitimate basis.

12. Refunds and Cancellations

Refunds are governed by the Edufocus Refund, Cancellation and Payment Policy published on the website.

Different products or services may have different refund conditions.

Where a course, batch, subscription or service has specific cancellation or refund conditions displayed before purchase, those conditions will apply together with the Refund Policy.

13. AI Tutor

Edufocus may provide AI-powered educational assistance.

The AI Tutor is an assistive educational technology and not a replacement for a qualified teacher, tutor, academic institution, professional adviser or other expert.

AI-generated responses may contain inaccuracies. Users are responsible for independently verifying important information.

Edufocus does not guarantee:

  • Examination results.
  • Academic scores.
  • Admission outcomes.
  • Employment outcomes.
  • Accuracy of every AI-generated response.

14. Intellectual Property

The Edufocus platform, including its software, source code, UI/UX, designs, logos, trademarks, platform content, graphics, documentation, proprietary workflows and AI features, is owned by or licensed to EDRACLE TECHNOLOGIES PRIVATE LIMITED or its licensors.

Users receive a limited, non-exclusive, non-transferable right to use the platform for its intended purpose.

Users may not copy, reproduce, modify, distribute, reverse engineer, scrape or commercially exploit Edufocus without written permission.

15. User Content

Users may upload or submit content such as profiles, course materials, homework, assignments, images, documents, reviews, feedback and messages.

You retain ownership of content that you legally own.

By submitting content, you grant Edufocus the limited rights necessary to host, process, display and transmit that content for providing the requested service.

You must ensure that your content does not:

  • Infringe intellectual property rights.
  • Violate privacy rights.
  • Contain unlawful material.
  • Contain malware.
  • Mislead other users.
  • Violate applicable laws.

16. Reviews and Feedback

Users may provide ratings, reviews and feedback where the feature is available. Reviews must be genuine and must not:

  • Be fraudulent.
  • Be defamatory.
  • Contain personal information of another person without permission.
  • Be posted in exchange for undisclosed compensation.
  • Manipulate platform ratings.
  • Edufocus may remove content that violates these requirements.

17. Referral and Reward Programme

Where available, Edufocus may offer referral rewards or Edufocus Points.

Reward programmes may have separate terms concerning:

  • Eligibility.
  • Successful referrals.
  • Expiry.
  • Fraud prevention.
  • Maximum rewards.
  • Redemption.
  • Edufocus may suspend rewards where fraudulent, duplicate, self-referral or abusive activity is detected.

18. Prohibited Activities

Users must not:

  • Attempt unauthorised access to the platform.
  • Circumvent security controls.
  • Upload malware.
  • Scrape or harvest platform data without permission.
  • Use automated bots to access the platform.
  • Interfere with platform operations.
  • Impersonate another person.
  • Post illegal or defamatory content.
  • Harass or threaten another user.
  • Attempt payment fraud.
  • Circumvent fees.
  • Infringe intellectual property rights.
  • Use Edufocus for unlawful commercial activities.
  • Exploit minors or vulnerable persons.
  • Use the platform to distribute spam.

19. Suspension and Termination

Edufocus may suspend or terminate an account where:

  • These Terms are violated.
  • Fraudulent activity is suspected.
  • Payment obligations are not met.
  • Platform security is threatened.
  • Illegal activity is identified.
  • User conduct creates risk to other users or the Company.
  • Where appropriate and legally required, users may be provided an opportunity to address the issue.
  • Termination does not automatically extinguish payment obligations or rights that accrued before termination.

20. Platform Availability

Edufocus aims to provide reliable service but does not guarantee uninterrupted or error-free operation.

Service may be temporarily unavailable due to:

  • Maintenance.
  • Upgrades.
  • Security incidents.
  • Internet failures.
  • Third-party service failures.
  • Cloud infrastructure problems.
  • Events beyond reasonable control.

21. Privacy

Use of Edufocus is also subject to the Edufocus Privacy Policy.

The Privacy Policy explains how personal information is collected, used, disclosed and protected.

22. Third-Party Services

Edufocus may use or integrate third-party services such as payment gateways, cloud services, communication providers, analytics providers, AI service providers and external educational resources.

Third-party services may have separate terms and privacy policies.

Edufocus is not responsible for the independent operation or policies of third parties, except to the extent required by applicable law.

23. Disclaimer

To the maximum extent permitted by law, Edufocus provides its technology platform on an "as available" basis.

We do not guarantee that:

  • The platform will always be available.
  • All information will always be error-free.
  • Every tutor or institute will meet a particular educational standard.
  • AI-generated information will always be accurate.
  • A course will produce a particular academic or professional outcome.
  • Nothing in these Terms excludes any consumer or statutory right that cannot lawfully be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, EDRACLE TECHNOLOGIES PRIVATE LIMITED shall not be liable for indirect, incidental, special or consequential losses arising from the use of the platform.

Where legally permissible, the Company's aggregate liability relating to a particular paid service shall not exceed the amount actually paid by the affected user for that service during the relevant twelve-month period.

This limitation shall not apply to liability that cannot legally be limited or excluded.

25. Indemnification

To the extent permitted by law, users agree to indemnify and hold harmless EDRACLE TECHNOLOGIES PRIVATE LIMITED, its officers, employees and service providers from claims, losses or expenses arising from:

  • Violation of these Terms.
  • Unlawful use of the platform.
  • Infringement of third-party rights.
  • Fraudulent activity.
  • Content submitted by the user.

26. Force Majeure

Edufocus will not be responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, war, government action, internet infrastructure failure, cyber incidents, epidemic/pandemic events, power failures or third-party infrastructure failures.

27. Changes to These Terms

We may modify these Terms from time to time.

Updated Terms will be published on the website.

Where material changes are required to be communicated, we may notify users through email, dashboard notification or other appropriate means.

Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

28. Governing Law

These Terms are governed by the laws of India.

Subject to applicable consumer protection and other mandatory laws, disputes shall be subject to the jurisdiction of the competent courts having jurisdiction over the Company's registered office in Haryana, India.

Nothing in this clause prevents a consumer from exercising a mandatory statutory right before a competent consumer authority or forum.

30. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to remain effective to the extent permitted by law.

31. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy and any applicable service-specific terms, constitute the agreement governing your use of Edufocus.
